The guidelines for transporting cannabis include the stipulation that it may not be mixed with any other substance.
Although this rigid definition means that you may not carry cannabis mixed with tobacco, it’s intended to clamp down on the transportation of nyaope and other ‘drug cocktails’ in which cannabis is used.
The Justice Department has invited the public to comment on the draft regulations by Thursday, 5 March 2026.
In terms of transporting cannabis, these are the proposed regulations
– The amount of cannabis, including cannabis that has not been removed from the cannabis plant, that an adult person may transport for private purpose may not cumulatively exceed 750 grams at any given time during the course of a single day.
– the cannabis being transported must be concealed from public view during transportation by ensuring that the cannabis is placed in the boot, trunk or at the back or in the enclosed storage compartment of the transporting vehicle;
– if it is not possible to transport the cannabis in the boot, trunk or at the back or in the enclosed storage compartment of the transporting vehicle, the cannabis may be transported in a storage container:
– the structure of the container must ensure that the cannabis is concealed from public view; and if the storage compartment is not fully enclosable, the cannabis must be covered to ensure that it is completely concealed from public view;
– the transportation of cannabis from one place to another is restricted to 750 grams per passenger, driver included;
– a person transporting cannabis may not mix cannabis or possess cannabis that is mixed with any other substance that is transported on a public road;
– cannabis may not be handled, held, examined or inspected while being transported;
– the fact that cannabis is being transported must not be revealed to other people who are not passengers;
– the driver of a vehicle must notify any passengers before they enter the vehicle that cannabis is being transported;
– if a passenger is carrying cannabis, the driver must verify it is not more than 750 gms;
– the driver may refuse to let the passenger into the vehicle if he or she refuses to let their cannabis be inspected or verified;
– only cannabis varieties or strains that only the permissible by any applicable law in the Republic may be transported in that vehicle (Editor’s note: goodness knows what this means).
